Taxation law
South African tax law and SARS compliance services
Income tax and VAT returns, compliance and record-keeping, strategic tax planning, and the objections, appeals and audits that follow when SARS disagrees.
Tax is one of the few areas where the administration matters as much as the law. A correct position, filed late or filed badly, still attracts penalties and interest — and the reverse is also true: clients who are compliant and well-documented get through audits with far less disruption.
Our tax practice combines legal advice with the practical administration of returns and disputes, so that the same office that advises you also files for you and, if it comes to it, represents you with SARS.
Tax preparation, filing and compliance
Income tax returns for individuals and businesses — ITR12 and ITR14 returns prepared and filed accurately and on time.
VAT returns — input and output calculations and submissions.
PAYE and employees’ tax — returns and submissions, including the reconciliations that employers are required to complete.
Company tax returns — and the supporting schedules that make them defensible.
SARS compliance management
We keep clients strictly compliant with the tax laws and regulations administered by SARS, which mitigates the risk of penalties and audits. This includes managing tax clearance and good standing where a client needs it for a tender or a contract.
Record keeping
We help clients keep accurate records of financial transactions and tax documents, so that a SARS review can be answered with evidence rather than reconstruction.
Tax strategy and advisory
Strategic tax planning — proactive advice on planning strategies that legitimately minimise tax liability while remaining fully compliant.
Advisory on specific tax regimes — legal opinions on capital gains tax, income tax, donations tax, estate duty and transfer duty, including the interaction between them in an estate or a property transaction.
Staying current — we track changes in tax legislation and regulations so that the advice you receive reflects the current law.
SARS disputes and audits
Representation with SARS — we act as your liaison with SARS through correspondence and official interactions.
Queries, disputes and audits — we attend to SARS queries, manage tax audits and handle formal disputes, including objections and appeals, on your behalf.
Why choose us for your tax needs
Our dual expertise in tax law and accounting practice gives a holistic view of your compliance. The aim is to remove the burden of SARS compliance so that you can run your business, with the reassurance that the tax position is managed professionally and defensibly.
Answers
Frequently asked questions
What is the difference between transfer duty and VAT on a property sale?
Most resale property transactions attract transfer duty, payable to SARS by the buyer. Property sold by a developer or builder as part of a taxable enterprise usually attracts VAT instead, with no transfer duty. A transaction attracts one or the other, never both. Our guide to transfer duty for 2026/27 sets out the current rates.
Should I accept an auto-assessment from SARS?
Not without checking it. An auto-assessment is based on the data the third parties reported to SARS, and that data is often incomplete — missing medical aid contributions, retirement annuity deductions or rental income. If the figures are wrong, accepting the assessment fixes them as correct until you request a correction.
What happens if I miss the filing deadline?
SARS imposes penalties and interest, and a failure to file can result in a request for a return, an estimate-based assessment, or suspension of your tax compliance status. If a deadline has been missed, tell us early — it is far easier to fix a late return than to reverse an estimated assessment.
